It will also depend on how activist those lower courts intend to be because based on the existing precedent, it would take significant judicial activism to completely disregard that. Most, but not all, jurists take legal precedent pretty seriously. Legislatures are increasingly made up of rich idiots with big mouths who want what they want and haven’t really thought through the actual legality of that. In any case, it will be interesting.
