It’s truly curious to me that you believe that asking people to take responsibility for themselves and to consider the impact of their words and actions is cruel. Your example of manslaughter vs. murder is a good one, and although there is a distinction as regards punishment as there should be, the person is still dead, no matter what your intentions were. This is the whole point! The outcome of your actions and words is what ultimately matters.
