People misuse that term all the time. It only references who has the burden of proof during a trial. If we presumed no-one was guilty even in the face of compelling evidence to the contrary until it had been proven, nobody would ever be tried. Of course accusations need to be investigated, but as you note, unconscious bias is rampant in this country - and everywhere because cognitive science says only 2% of what we believe to be thought is conscious - the rest takes place in the subconscious. Assuming that is unlikely that is taking place is kind of absurd, because it almost certainly is in nearly all cases.
I agree that we need to transform the foundational aspects of how the society functions and take it from a dominance based hierarchy system to something more egalitarian. Until we do, I don't see much truly changing.
