The problem arises in determining how drunk is too drunk to give consent. Obviously, the number of drinks won't work since that affects different people differently. But, as in the case of statutory rape, some conditions (being underage) mean that you are legally unable to give consent. I think there is such a thing as being too drunk to give consent - it's just going to be tough to have a bright enough line to determine where that actually is.
